Terms of Service

The rules under which you use the Abby app and service. Please read them before you start.

1Acceptance of the terms

These Terms of Service (the “Terms”) govern your access to the Abby mobile app, the web dashboard at abby.study, and related services (together, the “Service”). By creating an account or using the Service, you confirm that you have read, agree to, and accept these Terms on your own behalf and on behalf of the child whose profile you create.

If you do not agree with the Terms, do not use the Service. The Terms apply together with the Privacy Policy, which is an integral part of them.

2What Abby is

Abby is an educational app for activities with children aged 2–6 with autism spectrum disorder and developmental delays. The Service is built on the principles of Applied Behavior Analysis (ABA) and uses an adaptive engine that selects tasks based on a child’s level of skill mastery, gives the parent progress analytics and, on paid plans, adaptive task selection and educational tips.

The Service is operated by the Abby team. As of the publication date of these Terms there is no registered legal entity; the Terms will be updated once one is established.

3Important: Abby does not replace therapy

Medical disclaimer

Abby is a supplementary educational tool. The Service is not a medical device, does not make diagnoses, and does not replace in-person work with a developmental professional, a physician, or another qualified specialist.

Analytics, skill estimates, and educational recommendations are for reference and educational purposes only. Make decisions about your child’s therapy, treatment, and development together with qualified professionals. If you notice concerning symptoms, see a doctor.

4Who may use the Service

  • the account is created and managed by an adult parent or the child’s legal guardian;
  • you confirm that you are entitled to give consent to the processing of the data of the child whose profile you create;
  • the child does not get independent access to the account, settings, or network features — all decisions are made by an adult;
  • new accounts are registered in the mobile app; the web dashboard is for signing in to an existing account.

5Account and sign-in

Sign-in is passwordless — via a magic link or a 6-digit code sent to your email. You are responsible for access to your mailbox and for actions taken in your account. Contact us at hi@abby.study if you notice unauthorized access.

Changing your email or name is done through support and requires confirmation. One child profile corresponds to one device in the consumer mode; a multi-profile mode is available for centers and specialists.

6Subscription, plans, and payment

New users get a free trial period, so you can get to know Abby right away. Full access — all activities, a personal weekly plan, chat with Pingi, and detailed analytics — is unlocked by the Progress subscription, available with monthly and annual billing.

You can purchase Progress in one of two ways, depending on where you buy:

  • In the iOS app — through the App Store. The subscription renews automatically for the same period unless you turn it off no later than 24 hours before the end of the current period. Payment is charged to your Apple ID; you can manage and cancel the subscription in your App Store settings (Apple ID → “Subscriptions”). The price is shown in the app before purchase, in your local currency.
  • On the abby.study website — through your dashboard; payment is processed by our payment provider (Dodo Payments). The price is shown at checkout; you can cancel in the dashboard at any time — access remains until the end of the paid period.

Additionally, on the website only, a one-time “Progress Forever” purchase and add-ons are available — connecting a mentor and an additional child profile.

  • paid plans come with a trial period; you can cancel the subscription at any time — access remains until the end of the paid period;
  • with annual billing, the price is fixed for the paid year;
  • we do not store card details — payments are processed by the App Store or the payment provider;
  • refunds for the unused part of a paid period are handled in accordance with applicable law and the rules of the App Store or the payment provider.

7Acceptable use

By using the Service, you agree not to:

  • use the Service in violation of the law or the rights of third parties;
  • attempt to gain unauthorized access to the Service, other accounts, or the infrastructure;
  • copy, decompile, modify, or create derivative works based on the Service, except as expressly permitted by law;
  • interfere with the operation of the Service, overload the infrastructure, or use automated data collection;
  • impersonate another person or provide misleading information when creating a profile.

8Data and content

The child’s profile, activity data, and progress belong to you as the parent. We process them to operate the Service as described in the Privacy Policy. You may request an export or deletion of the data at any time.

You are responsible for the accuracy of the data you enter (the child’s name, age, interests). We may connect a mentor to a child’s profile only upon your explicit action in the app (entering the mentor’s referral code).

9Intellectual property

The Service itself — the source code, design, activities, methodological materials, the Pingi mascot, texts, and graphics — belongs to the Abby team and is protected by law. These Terms do not transfer any rights to the Service to you, except a limited, non-exclusive, revocable right to use it for personal, non-commercial activities with your child (for centers and specialists — under the terms of the corresponding mode).

10Service availability and changes

We strive for stable operation of the Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or causes beyond our control. We may add, change, or discontinue individual features; we give advance notice of material changes affecting paid plans.

11Limitation of liability

The Service is provided “as is” and “as available”. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for decisions about a child’s development, therapy, or treatment made on the basis of information from the Service. The Service is not a substitute for professional help (see §3).

Nothing in these Terms limits liability that cannot be excluded under applicable law, and nothing affects consumer rights granted by mandatory provisions of law.

12Suspension and termination of access

You may stop using the Service and delete your account at any time. We may suspend or terminate access in the event of a material breach of these Terms or where there are legal grounds to do so. After account deletion, data is processed as described in the Privacy Policy (including backup retention periods).

13Changes to the Terms

We may update these Terms. We will give advance notice of material changes — by email and in the app. Continued use of the Service after the changes take effect constitutes acceptance. If you do not agree, stop using the Service.

14Governing law and disputes

Until a legal entity is registered as the Operator, disputes are resolved primarily through negotiation. Write to us at hi@abby.study — we will try to resolve the matter. The governing law and jurisdiction will be specified in an updated version of the Terms after a legal entity is registered. Mandatory consumer rights in your place of residence remain unaffected in any case.
